Terms of Service
Welcome to responsio.app! These Terms of Service ("Terms") govern your access to and use of the responsio.app platform, website located at https://responsio.app and https://*.responsio.app ("Service" or "Platform" or "Responsio"), and any associated widgets, software, and services provided by responsio.app ("we", "us", or "our").
By registering an account or using our Service, you ("Client", "you") agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.
Our Privacy Policy and Cookie Policy are integral parts of these Terms and are incorporated herein by reference. By accepting these Terms or using our Service, you acknowledge that you have read and understood how we process your data and use cookies.
1. Definitions
- Service/Platform: The SaaS platform hosted at responsio.app and all related features, APIs, and tools provided by us.
- Client: The individual or legal entity creating an account on responsio.app to collect feedback for their applications or websites.
- Project: A dedicated workspace created by a Client within responsio.app to manage feedback, boards (e.g., Bugs, Feature Requests, Ideas), and settings.
- Widget: The embeddable code snippet or script provided by responsio.app that the Client installs on their own website or application (e.g., example.com).
- End-User: A visitor or user of the Client’s website or application who interacts with the Widget to submit feedback, bugs, or ideas.
2. Account Registration and Security
- Account Creation: To use the Service, you must register for an account by providing a valid email address and a secure password.
- Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
- Accuracy of Information: You agree to provide accurate, current, and complete information during registration and to keep your account details up to date.
3. Service Functionality & Widget Integration
- Projects and Boards: Clients can create Projects and boards (e.g., Bugs, Feature Requests, Ideas) to aggregate and display feedback from their End-Users.
- Widget Implementation & User Data:
- The Widget allows Clients to seamlessly pass End-User metadata (e.g.m id, name, email, and profile picture URL) to Responsio.
- End-Users do not need to register or create an account with Responsio to submit feedback. Their identity is authenticated via the parameters provided by the Client’s integration.
- Data Visibility & Privacy:
- Public Information: Content submitted by End-Users (feedback, votes, comments), along with their display name and profile picture, may be publicly visible to other End-Users interacting with the Client’s board or Widget.
- Private Information: Sensitive data, such as the End-User's email address and internal User ID, remains strictly private and accessible only to the Client (and team members explicitly authorized by the Client).
- Responsio's Commitment: Responsio will not sell, rent, share, or use any End-User data for its own marketing or independent business operations.
4. Data Protection and Privacy (GDPR & International Compliance)
- Roles of the Parties:
- Client as Data Controller: The Client acts as the Data Controller (or "Business") for all End-User personal data passed through the Widget to Responsio.
- Responsio as Data Processor: Responsio acts solely as a Data Processor (or "Service Provider"), processing End-User personal data on behalf of, and in accordance with the instructions of, the Client.
- Client Obligations:
- The Client is solely responsible for ensuring they have a lawful basis (e.g., legitimate interest or explicit consent) to collect and transfer End-User data to Responsio.
- The Client must maintain an up-to-date Privacy Policy on their own platform that informs End-Users about third-party processors such as Responsio.
- Security: Responsio implements reasonable technical and organizational measures to protect Client and End-User data against unauthorized access, loss, or alteration.
5. Intellectual Property and Content Rules
- Responsio Intellectual Property: All rights, title, and interest in and to the Platform, including software, design, logos, trademarks, and Widget code, remain the exclusive property of Responsio.
- Feedback Content: Any content, feedback, suggestions, or bug reports submitted by End-Users or Clients remain the property of the Client (or the End-User, as governed by the Client’s own terms).
- Acceptable Use: You agree not to misuse the Service or assist anyone else in doing
so. Specifically, you must not:
- Interfere with the Service: Interfere with or impair the intended operation of the Service, or attempt to access it using any method other than the interface and instructions we explicitly provide.
- Unauthorized Access & Accounts: Attempt to create accounts, access the Service, or collect any information through automated or unauthorized means.
- Scraping and Crawling: Crawl, scrape, index, or otherwise cache any content or data from our website, Platform, or Widget.
- Modification & Reverse Engineering: Modify, translate, adapt, create derivative works of, reverse engineer, decompile, or attempt to extract the source code of any part of the Platform or Widget.
- Malicious Content: Upload, transmit, or distribute illegal, harmful, defamatory, or abusive content, or introduce viruses, malware, or malicious code into the System.
6. Limitation of Liability and Warranties
- "As Is" Service:The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
- Limitation: To the maximum extent permitted by law, Responsio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
- Cap on Liability: Responsio's total aggregate liability arising out of or related to these Terms shall not exceed the total amount paid by the Client to Responsio in the three (3) months preceding the event giving rise to the claim.
7. Termination and Account Deletion
- Termination by Client: You may delete your account at any time via your account settings.
- Data Deletion: Upon account deletion, all associated Projects, boards, and End-User data submitted via your Widget will be permanently deleted from our active databases within a reasonable timeframe.
- Termination by Responsio: We reserve the right to suspend or terminate your account immediately if you breach any material provision of these Terms.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify Clients of material changes by sending an email or placing a prominent notice within the Platform at least 14 days prior to the changes taking effect. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.
9. Governing Law and Contact
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.
